In 2021, the Department of Justice (DOJ) reopened its long-running inquiry into alleged anticompetitive practices by the National Association of Realtors (NAR) which they are concerned might contribute to excessive costs to consumers for real estate transactions. Having settled the issue out of court in both 2008 and 2020, the April 5th ruling of the U.S. Court of Appeals for the District of Columbia will allow the DOJ to proceed with its inquiry, following its commitment to “fighting to lower the cost of buying and selling a home.”
