House Financial Services Committee Chairman Patrick McHenry, (R-NC) along with Representatives Andy Barr (R-KY),Bill Huizenga (R-MI), and Senate Banking Committee Ranking Member Tim Scott (R-SC), led a bicameral group of 132 members of Congress in filing an amicus curiae brief to the Supreme Court in CFPB v. Community Financial Services Association of America, Limited et al. The brief urges the Court to uphold the Fifth Circuit’s decision that the CFPB’s funding structure is unconstitutional and to shift their funding structure to derive from congressional appropriations.
